The book examines the relationship between competition policy and environmental sustainability within the framework of European Union law. It takes the fight against climate change as an urgent need and analyses to what extent competition law instruments can contribute to sustainability without undermining their basic principles. After introducing the subject and the analytical framework, it addresses business cooperation agreements, abuse of dominance, merger control and state aid.
Each chapter assesses the current situation and recent developments, identifies existing shortcomings and sets out concrete proposals for improvement and for their practical implementation, in order to provide useful legal criteria for understanding this complex intersection between sustainability and competition.
The book offers:
Analysis of business cooperation agreements with environmental objectives and their treatment under European Union competition law.
Examination of abuse of dominance and merger control through the lens of environmental sustainability.
In depth review of state aid control in relation to measures supporting the transition to a climate neutral economy.
